Terms and conditions of Colour Me Shea

Article 1 — Object
L’OCCITANE, (PTY) LTD, with its principal office located at 59 Woodlands Avenue, Hurlingham Office Park. Hurlingham Sandton 2196, (“Organizer”) is organizing a marketing game named Let’s Color Together Game (hereinafter the “Game”), running from May 11 through June 30, 2020 via the Game platform at https://loccitane-omy-3a690.firebaseapp.com/?lang=za_en      
Article 2 — Entering the Game
2.1 Entry conditions
The Game is open to South African citizens or legal South African residents who have reached the age of majority in their state of residence and are at least sixteen years old as of the date of entry (hereinafter  “Participant(s)”).  Employees, interns, officers and directors of the Organizer and each of their parent and affiliated companies, suppliers as well as the immediate family (parents, siblings, children, spouses and life partners of each, regardless of where they live) and household members of each such employee, officer, or director (whether related or not) are not eligible to participate in the Game. The Game is void where prohibited by law.
By participating in the Game, Participants acknowledge and agree to their full acceptance of these Game Rules (the “Rules”).
2.2. Procedure for entry
It is a free game without obligation to purchase something. To participate, it is just necessary to enter into the Game and Coloring the Shea Fresco via https://www.loccitane.com/en-ca/lets-color-together.
To win something, you have to:

Prizes have been randomly distributed behind OMY fresco elements, to be discovered when coloring is completed.
Entering the Game indicates full and absolute acceptance of all provisions of the present regulations, of the rules of conduct generally applied on the Internet, and of the laws and rules applicable to free to enter into the Game.
Any entries that are incomplete or inaccurate, or that do not follow the procedure set out above shall not be considered and so shall invalidate the entry.

Article 3 — Prize
Prizes that are going to be distributed into this game are Voucher codes to get a free L’Occitane “Gift With Purchase” product, which is a variety of items), for any purchase overR500 on https://za.loccitane.com/  , but not cumulative with any other discount.
The Participants undertake that, should they win, they shall accept the prize offered them, without the possibility of exchanging these items in particular against cash payment or other products or services of any kind.
The Organizing Company reserves the right to replace any prize with another prize of equivalent value and characteristics, whatever the reason for this replacement, without incurring liability in this regard.
Article 4 — Awarding of Prize
The Participant winner (the “Participant Winner”) will see appearing the Prize on a message just after having colored fresco elements.
On https://za.loccitane.com/ the Participant Winner has to build a purchase of at least R500 and enter code received from the Game at checkout.
In Stores, the Participant Winner will need to announce its Prize by giving the Voucher code to the salesperson.
Prize is available from May 11th, 2020 to June 30th, 2020.
The Participant Winner must comply with the provisions of the regulations. Should it transpire that the Participant Winner does not meet the criteria laid down in the present regulations, he or she shall not be awarded the Prize.
No objections or claims of any kind may be made with regard to the Prize. The Participant Winner undertakes to refrain from attempting to hold the Organizing Company liable in any way as regards the Prize.
It is stipulated that the Organizing Company shall not provide any services or guarantees, with the winnings consisting exclusively of the Prize presented as indicated above.
Article 5 — Use of personal data
No personal data will be collected.
Article 6 — Limitation of liability
Entering the Game constitutes Participants’ unqualified acceptance of all provisions of the Rules in their entirety. By participating in the Game, Participants agree, to the fullest extent permitted by law, to release and hold harmless Organizer, and its respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Game. Organizer assumes no responsibility or liability for the following: (i) telephone or technical malfunctions that may occur; (ii) any incorrect or inaccurate information, any of the equipment or programming associated with the Game, or any technical or human error that may occur in connection with the Game; (iii) any injury or damage to Participants or their property related to or resulting from participating in the Game; (iv) the destruction of information provided by Participants for reasons not attributable to the Organizer; or (v) inaccessibility or unavailability of the Internet or any combination thereof. 
Entering the Game implies familiarity with, and acceptance of, the characteristics and limits of the Internet, in particular as regards technical performance, response times for consulting, examining or transferring information, risks of interruption and, in more general terms, the risks inherent in any connection to, and transmission via, the Internet, the lack of protection for certain data against any breaches and risks of contamination by any Internet viruses.
The Organizer may not be held liable in the event of the malfunctioning of the Internet, or of the preventing access to, or satisfactory running of, the Game. In particular, the Organizer may not be held liable for any external malicious acts.
While the Organizer is doing all it can to provide users with information and/or resources that are available and verified, it may not, however, be held liable for any errors (in particular as regards displays on the Game sites, errors in emails), for unavailability of information and/or for the presence of viruses on the site.
It is up to each Participant to take all appropriate steps in order to protect his or her own data and/or software stored on his or her computer and telephone equipment against any attacks. Any individual accessing the Game site does so under his or her sole responsibility.
If, for any reason, the Game is not capable of running as planned, including because of, tampering, unauthorized intervention, fraud, technical failures, force majeure, or any other cause beyond the control of Organizer that may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game, Organizer reserves the right, in its sole discretion, to rescind, cancel, terminate, modify or suspend the Game.  Any instances of fraud or of failure to obey the Rules may lead to the party responsible being disqualified from the Game, and the Organizer reserves the right, if appropriate, to take legal action against said party.
Article 7 — Access to, and interpretation of, the regulations - modifications
7.1 Access
The Rules may be viewed in their entirety on the Organizer’s website :link to be created for https://loccitane-omy-3a690.firebaseapp.com/?lang=za_en .  Any inquiries must be set out in writing and sent to the Organizer at the address stated above prior to February 16, 2020.
7.2 Interpretation of the regulations
Any questions relating to application or interpretation of the Rules and any unexpected questions that may arise shall be resolved by the Organizer in its sole and absolute discretion.
7 The Organizer reserves the right to extend, curtail, modify or cancel the Game at any time, and in particular in the event of an occurrence of force majeure, without the Participants being entitled to claim any compensation or any unearned Prizes as of the effective date of the termination.
Any modifications shall be set out in an amendment posted on the Organizer’s website https://loccitane-omy-3a690.firebaseapp.com/?lang=za and on the Game platform.
Article 8 — Applicable law and jurisdiction
The Rules and operation of the Game and any disputes relating thereto or arising therefrom shall be governed by and construed in accordance with, the laws of South Africa without giving effect to any choice of law or conflicts of law rules (whether Canada or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than South Africa and shall be resolved individually, without resort to any form of class action.
